Step-by-Step NRI ITR Filing Process 2026

Step 1 — Residential Status Confirm Karo
Passport se India entry/exit dates nikalo। Har financial year (April-March) ke liye India days count karo। 182 days se kam = NRI। Yeh step skip mat karo — galat status select karna baaki sab galat kar deta hai।
Step 2 — AIS Aur Form 26AS Download Karo

  • NRO FD interest: ₹85,000 (TDS 30% = ₹25,500 already kata)
  • Mutual fund LTCG: ₹1,40,000 (above ₹1.25 lakh exempt = ₹15,000 taxable)

Income calculation:

Rental income (after 30% standard deduction) ₹1,26,000
NRO interest ₹85,000
LTCG on MF (taxable) ₹15,000

₹2,26,000 < ₹2,50,000 basic exemption → Zero tax liability

Property Sale Karne Wale NRIs Ke Liye Special Guide

Property sale NRI ke liye sabse complex transaction hai। Kuch important points:

Buyer TDS Kaatega — Gross Value Par

NRI se property kharidne par buyer ko TDS kaatna mandatory hai — gross sale price ka percentage — sirf gain par nahi:

  • LTCG (2+ saal held): 12.5% of gross sale price + applicable surcharge
  • STCG (2 saal se kam): 30% of gross sale price + surcharge

Example — Property TDS vs Actual Tax

Suresh ne ₹1 crore mein property bech di — bought 2018 mein ₹40 lakh mein। LTCG = ₹60 lakh।

Buyer TDS: 12.5% × ₹1 crore = ₹12.5 lakh

Actual tax: 12.5% × ₹60 lakh = ₹7.5 lakh

Refund: ₹12.5 lakh – ₹7.5 lakh = ₹5 lakh — ITR file karke claim karo

Agar Section 54 ke under naya ghar kharida — LTCG exempt — poora ₹12.5 lakh refund possible।

Lower TDS Certificate — Form 13

Agar aap property sell karne se pehle ITR file karke dikhana chahte ho ki actual tax liability buyer ke TDS se kam hai — AO se Form 13 (Lower TDS Certificate) le sakte ho। Certificate milne par buyer lower rate par TDS kaatega। Yeh especially useful hai jab capital gain exemption (Section 54) claim karni ho।

DTAA Benefit Claim Karna — Step by Step
